Do you need an ITIN if you own a US LLC?
Usually not, and the confusion comes from mixing up two different tax numbers that serve two different purposes. Here is the actual distinction.
The EIN and the ITIN get confused constantly, and the confusion is understandable: both are IRS-issued numbers, both have nine digits, and both show up in the same conversations about forming a US company as a non-resident. They are not interchangeable, and knowing which one your situation actually requires saves a genuinely unnecessary application.
What each number is actually for
| EIN | ITIN | |
|---|---|---|
| Identifies | The business entity (your LLC) | An individual for federal tax purposes |
| Needed for | Opening a business bank account, hiring, most banking and payment platforms | Filing a personal US tax return, claiming tax treaty benefits |
| Requires an SSN? | No | No, that is precisely what it substitutes for |
| Required just to own an LLC? | Yes, in practice | Not automatically |
Why owning an LLC does not automatically require an ITIN
The EIN identifies your company to the IRS, banks, and payment processors. It exists at the entity level. An ITIN exists at the individual level, and its main purpose is letting a person without an SSN file a personal US tax return or claim a benefit under a tax treaty. Simply forming and owning a single-member LLC does not, by itself, create a personal US filing obligation that requires an ITIN.
When an ITIN actually becomes necessary
- You personally need to file a US individual tax return, for example reporting effectively connected income.
- You want to claim a benefit under a tax treaty between the US and your home country that requires a US taxpayer identification number.
- A specific form or process you are dealing with explicitly asks for an individual taxpayer ID rather than the entity's EIN.
If none of those apply to you, the EIN your LLC already has is generally sufficient for forming the company, opening its bank account, and running it. Applying for an ITIN preemptively, on the assumption that owning an LLC requires one, is usually unnecessary work.
The EIN comes with formation, no ITIN required.
