EIN timelines

How long an EIN really takes without an SSN.

Ask three sources how long a foreign founder's EIN takes and you get three different answers. Here is why they disagree, and a realistic range to actually plan around.

Search for how long an EIN takes as a foreign founder and the published numbers will not agree with each other. One source says a matter of days, another says weeks, another says months. None of them are necessarily wrong; they are describing different routes through the same process.

Why the estimates contradict each other

A US applicant with an SSN can get an EIN online, instantly, through the IRS's own assistant. That is the fast case almost every generic article about EINs is actually describing, and it is not available to you as a foreign founder with no SSN or ITIN. Once that route is off the table, you are choosing between phone and fax, and each behaves differently.

RouteRealistic rangeWhat determines it
Online (SSN/ITIN only)ImmediateNot available to a foreign responsible party
PhoneSame call, if you get throughUS Eastern business hours, hold times, one call per attempt
FaxCommonly around a week or twoIRS fax queue volume, accuracy of the SS-4 on first submission
MailSeveral weeks to a few monthsPostal transit both ways, IRS mail-processing backlog

The single biggest variable is not the route

It is whether the SS-4 is correct the first time. A rejected or incomplete fax does not join a queue for a fast retry; it goes back to the end of the line, often as a new submission days or weeks later. Line 7b, the entity type on line 9a, and the reason for applying on line 10 are the three fields most likely to cause a rejection when filled out by someone unfamiliar with the foreign-applicant version of this form.

A realistic range to actually plan around

For a correctly completed fax submission, a few business days to roughly two weeks is a reasonable expectation in a normal processing period. Build in slack rather than planning around the fastest number you have seen quoted, and treat the EIN as the thing that has to arrive before banking, Stripe, or anything money-related can move forward.

We file it once, correctly, the first time.

EIN handled as part of formation, with the fields foreign applicants get wrong already right.

Common questions

EIN timelines, answered.

Why do EIN timeline estimates online disagree so much?
Most generic articles are describing the instant online process, which is not available to foreign founders without an SSN or ITIN. Once you are on the phone or fax route, timelines depend on IRS queue volume and whether the SS-4 was correct the first time.
Is phone or fax faster for a foreign EIN application?
Phone can resolve in a single call if you get through, but the line runs on US Eastern business hours and getting connected can take persistence. Fax is more predictable on average but takes longer per attempt.
What is the single biggest cause of EIN delays?
An incorrectly completed Form SS-4, especially line 7b. A rejected submission does not get a fast retry; it effectively restarts at the back of the queue.
Can I speed up my EIN by paying for expedited processing?
Some formation providers offer expedited handling on their side of the process, but the IRS itself does not offer a paid fast lane for a foreign applicant's EIN.

NameMarshal is not a law firm or an accountancy practice, and nothing here is legal or tax advice. Timelines vary with IRS processing volume, which changes throughout the year.
